The department specialises in various facets and stages of insolvency and business recovery, both local and cross border, including:
- Voluntary and forced winding up and deregistration of corporate entities both private and public
- Voluntary and forced personal sequestrations
- Forensic investigations for clients in respect of employees or third parties
- Advisory services for clients faced with a choice between business recovery or winding up/sequestration
- Litigation pertaining to winding up or sequestration applications
- Advisory services to clients as creditors in insolvent estates including:
- Assisting in and conducting insolvency enquiries
- Acting as liaison between clients, trustees, liquidators and the Masters office in regard to proof of claims and the winding up process generally.
Our client in this field include corporate and individuals as well as banks, credit guarantors, public bodies (e.g. Parliament and Local Government) and liquidators/insolvency trustees. We are able to advise and assist clients both before and after the problem has materialised. We are thus able to ensure that the correct strategic decision is made at the given stage in order to eliminate or, at worst, limit the loss suffered by the client. We have built up extensive contacts in all areas of this field both within South Africa and abroad.
